Datenschutzhinweise / Privacy Notice
Instagram-Automatik von German Digital Engineering (@german.digital.engineering) und Berlin Motion Design (@berlin.motion.design) · Stand / As of: 28.10.2026

5. Rechtsgrundlage
Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse).
| Was | Wie lange | Warum |
|---|---|---|
Privacy notice under Art. 13 GDPR
This notice covers the automatic reply to comments under our Reels on Instagram. It applies to both accounts as soon as the automation is active on them. It covers only this automation, not your use of Instagram itself.
1. Controller
Marcel M. Jordan, sole proprietor, Tiriotstraße 31, 13127 Berlin, Germany
Email: info@roema-design.de
Instagram direct message to @german.digital.engineering or @berlin.motion.design
No data protection officer is appointed because none is legally required.
Legal notice: https://www.roema-design.de/social/impressum.html
2. How the automation works
- You comment a keyword named in one of our Reels.
- Our app detects the keyword and sends you one private message (Instagram "Private Reply") asking "Do you follow us? Reply with Yes" (in German). Under your comment, a short public note "DM ist raus" (DM sent) with an emoji appears.
- If you reply with a message, the app asks Instagram whether you follow the account. The question mentions "Ja" (yes), but the app treats any message from you as a reply, not only "Ja". If you follow, you receive the promised prompt as a text message. If you do not, we ask you in a message to follow the account and to write again. This can happen up to three times per keyword.
- The first message ends with a link to this notice.
- We send further messages only in response to a message from you: the prompt, the requests to follow (at most three) and, if you write "Delete my data" or "Daten löschen" via Instagram, a single deletion confirmation (see Data deletion). If you do not write, nothing follows the first message.
3. Data we process
- Comment ID and comment text (the keyword)
- Instagram-scoped ID (the pseudonymous user identifier Instagram gives our app) and, if provided by Instagram, your username
- The text of your reply (for example "Ja") and of our messages to you
- Follower status: Instagram tells us whether you follow the account (yes or no), nothing more, and no follower lists
- Timestamps (comment, question, reply, delivery) and the status of the flow (for example "asked", "not following", "delivered")
We collect no special categories of personal data and read no other messages or profiles.
4. Purpose
To send you the content you requested with your keyword, and to make sure you receive it only once. The follower check serves to provide the content to followers as announced.
5. Legal basis
Art. 6(1)(f) GDPR (legitimate interests). Our interest is to deliver the announced content to the people who request it and to avoid duplicate messages. You triggered the flow with your own comment, so a message is to be expected. The data is limited to what is necessary, the messages contain no advertising, and you can object at any time (section 10). For the automation we do not ask for consent. Section 7 applies to the login page.
6. Recipients
Comments and messages run through Instagram. Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland, is responsible for Instagram and processes data under its own data policy. Our app receives the data listed in section 3 from Meta and sends our messages to you through Meta. Meta may transfer data to the USA; Meta Platforms, Inc. is certified under the EU-US Data Privacy Framework, for which the European Commission adopted an adequacy decision on 10 July 2023 (Implementing Decision (EU) 2023/1795). Beyond that, we pass no data to third parties, sell no data and use no advertising or analytics services.
This page is hosted by Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus (Hostinger). The server location is a data centre in Germany (Frankfurt am Main), so processing takes place within the EU. When you open this page, Hostinger, as a technical service provider, automatically processes server log files transmitted by your browser (in particular IP address, date and time of the request, page requested, amount of data transferred, referrer URL, browser and operating system). This is technically necessary to deliver the page and to keep it stable and secure. The legal basis is Art. 6(1)(f) GDPR. A data processing agreement under Art. 28 GDPR is in place with Hostinger. Log files are deleted as soon as they are no longer needed for technical operation and security. The other pages of this offering (all except the login page verbinden.html) set no cookies and load no scripts, fonts or images from third parties. Section 7 applies to the login page.
7. Login page for the Meta review (verbinden.html)
On the page verbinden.html, people with a Facebook account, above all Meta's reviewers, can log in to see which Facebook Pages and Instagram accounts are connected to the app. The page is not meant for anyone else.
- Only after the click: When you open the page, nothing is loaded from Meta and no cookie is set. Only when you click the button "Continue with Facebook" does your browser load Meta's JavaScript SDK (connect.facebook.net). Your browser then sends your IP address and browser data to Meta. Meta may set cookies or store data in your browser. A notice appears before the button.
- Login at Meta: The login itself takes place at Meta. Meta Platforms Ireland Limited (address in section 6) is responsible, as a controller in its own right, for the login and the data processed in it, and processes the data under Meta's data policy. Meta may transfer data to the USA; what section 6 says about the EU-US Data Privacy Framework applies.
- Access token: The access token that Meta issues after login stays in your browser. The page does not store it, does not display it and does not transmit it to us. The page sends no data to our server.
- What is shown to you: The name of the Facebook Page, the Instagram username of the connected account and the permissions you granted. The display is produced in your browser only. We learn nothing of it.
- Legal basis: Your click after the notice, that is your consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG for loading the SDK and for Meta storing or reading information on your device). You can withdraw it at any time with effect for the future by logging out on the page, leaving the page and deleting the site data for Meta in your browser. Without your click none of this takes place. The server log files at Hostinger (section 6) arise when the page is opened, as with all other pages.
8. Storage location and retention
The data is stored locally on a computer of the controller in Germany, not on this website and not with a cloud service.
| What | How long | Why |
|---|---|---|
| Raw data: comment text, comment ID, username, message texts, timestamps, status | 30 days | Instagram allows the private reply only within 7 days and follow-up messages only within 24 hours. After that we do not need the data; 30 days leave time for troubleshooting and access requests. |
| Comment ID in the technical "already seen" marker (the number only, no text, no name) | up to 8 days | Prevents the same comment from being answered twice, also after a deletion at your request. |
| Block entry "already answered" per person and keyword (Instagram-scoped ID, keyword, time) | up to 12 months | Without it you would receive the same message each time you comment again. We store only the identifier and the keyword, no text. |
The app deletes everything automatically after these periods. We delete earlier on request (section 10 and Data deletion).
9. No profiling, no automated decision-making (Art. 22 GDPR)
We build no profiles and assess no personal traits. The reply to your keyword and the follower check are automated, but they are not a decision that has legal effects on you or similarly significantly affects you: they concern sending free content. If you do not follow the account yet, you receive the content after following and replying again; no claim is denied and no disadvantage arises. You can write to us at any time and a person will look at your request.
10. Your rights
You have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability (Art. 20) and objection (Art. 21 GDPR). Write to us by email or Instagram direct message; how deletion works is described under Data deletion. Providing data is not required: without your comment we process nothing about you.
Notice of your right to object (Art. 21 GDPR): Because we rely on legitimate interests (Art. 6(1)(f)), you may object at any time, on grounds relating to your particular situation, to the processing of your data. A simple message to us is enough.
11. Right to lodge a complaint
You may complain to a data protection supervisory authority. The authority responsible for us is the Berlin Commissioner for Data Protection and Freedom of Information, Alt-Moabit 59-61, 10555 Berlin, Germany, datenschutz-berlin.de. You may also contact the authority where you live.
12. Changes
We update this notice when the process or the law changes. The version published here applies.
